HEALTH & SAFETY WAIVER

To:

  • The Hunterville Huntaway Festival Society Inc. and its Executives
  • The landowners of land involved in the Hunterville Children's Junior, Intermediate and Teens Shemozzle Event
  • The lessees of the Landowner of land involved in the Hunterville Children's Junior, Intermediate and Teens Shemozzle Event
  • (“the Indemnified Parties”)

I Declare:

  • I am:
  1. An entrant in the Junior, and/or Intermediate, and/or Teens Shemozzle;

Or

  1. The parent/caregiver/guardian of entrant/s in the Junior, and/or Intermediate, and/or Teens Shemozzle (“the Event”)
    1. I give my consent for them to participate in the Event.
    2. I accept the conditions attaching to participation in this Event on behalf of the entrant.
  • I confirm that:
    1. I have read and understood the attached “Schedule” below
    2. That I acknowledge and fully appreciate the risks and dangers of participating in the Event and fully accept the risks to my health, safety and wellbeing associated with my participation during and after the Event.
  • I agree that I will be required to participate in a pre-race safety briefing on known hazards or risks that could be encountered during the Event.
  • I acknowledge that if following the briefing I have any misgivings or concerns for my health, safety or well-being from participating in the Event, I may prior to the commencement of the race withdraw.
  • By participating in the Event
    1. I acknowledge and agree that the Event Organisers (including all officials and event volunteers), the Landowner and Lessees upon whose land the event is held do not provide any warranties regarding my health, safety and/or wellbeing with regard to my participation in the Event.
    2. I hereby agree to indemnify and keep safe, harmless and indemnified the Event organisers and the above owners and lessees from and against all or any claims, costs, suits, prosecutions or losses that they may occur or suffer as a result directly or indirectly of my participation the Event
  • I acknowledge that the items referred to in the Schedule are non-exhaustive and that I must exercise care, common sense and due diligence in my participation.
  • I agree to follow the directions and safety warnings given to me by any of the Indemnified Parties and by the event organisers
  • I acknowledge that I must use safety equipment while participating in the Event including, but not exclusive, to clothing and footwear suitable for the safe crossing of hill country farmland, farm fences, water and other hazards.
  • I agree to take all reasonable steps to ensure the health, safety and wellbeing of all participants, officials, stakeholders, dogs and other livestock involved or encountered during the Event.
  • I agree that
    1. I will not take onto the land, use or be under the influence of any illegal drug(s) or substances;
    2. I will not be under the influence of alcohol when participating in the Event;
    3. Enter into any enclosed paddock unless requested, directed or supervised to do by the Indemnified Parties or any of the Hunterville Huntaway Festival Committee.
  • I confirm I am either
    1. In good health, or
    2. I have listed all physical disability(ies) and/or chronic illness(es) or conditions on the Race Entry Form.

Or

  • In the event that I am completing this waiver and warranty as the parent/caregiver/guardian of the Entrant, then all references (inter alia) to me shall be deemed to mean and include the Entrant as the Entrants as the case may be

SCHEDULE OF CONSIDERATIONS

With reference to the Event, the following risks, concerns and considerations must be considered and understood by all participants and/or their parent/guardian.

  • The Event is run on uneven hill country land.
  • That land can be slippery, rough, uneven, steep, unstable and boggy. It may contain ‘Tomos’.
  • There will be obstacles to cross that may be hazardous including fences, gates, wet areas, springs, bogs, drains and dams of varying degree of hazard. Dams may be deeper than imagined, Bogs may be wetter and deeper than anticipated.
  • Weather may exacerbate risks.
  • Dogs and other animals will be present during the Event, these animals can be unpredictable and may become aggressive.
  • You are likely to encounter barbed wire and/or electric fences, items of plant and equipment. All must be treated with caution and all electric fences considered ‘live’

The environment in which the Event is staged contains multiple hazards and all participants needs to exercise caution, care, full attention and common sense during their participation and acknowledge that their own personal health, safety and wellbeing together with all other competitors, spectators, volunteers and Indemnified Parties is a priority.
